Abstract

This article develops an original argument that accepted notions of property theory do not adequately explain the dynamic interaction between environmental legislation targeted to the protection of biodiversity, and property rights in land. It challenges the theory of Kevin Gray and JW Harris and offers an alternative paradigm.
