China is fast becoming one of the most important nations in the development, commercialization and regulation of nanotechnology. Nanoscience and nanotechnology are one of the four major fields of science research in China’s medium and long-term plans for development. In this article, Deming Liu provides an in-depth comparison of the perception of risks associated with nanotechnology in the U.S., Europe and in China. Dr. Liu goes on to examine the patent law of China and the hurdles to patentability of nanotechnology inventions in China. Dr. Liu compares regulations and patent laws in China with those in the United States. In contrast to the situation in the U.S., there is no “patent thicket” in China; rather, China faces the problem of a lack of patents. Dr. Liu concludes the article and explains how the Chinese government is seeking to overcome the problem of a lack of patents and how it seeks to encourage patenting with various policies and measures.
