The United Nations General Assembly request to the International Court of Justice for an advisory opinion on the separation of the Chagos Islands (which were to become known as the British Indian Ocean Territory - BIOT) from Mauritius raised a plethora of legal issues including the right of the British government to declare a marine protected area over much of the sea surrounding these islands. This article is one of a series published in the interim between the hearing and the delivery of that opinion and follows from a symposium on the issues held in Switzerland and hosted by St Gallen University.
