Abstract

This article reviews the EU remedy of ineffectiveness and its interrelation with the other pre andpost-contractual remedies, as well as assessing and evaluating the post-contractual remedies frameworkproposed by the Government in the Procurement Bill (now the Procurement Act 2023). A simpler and more effective post-contractual remedies framework is proposed.
