Notes: This essay appears in an extremely well regarded outlet. It makes a distinct contribution by identifying the ideal of ethical community as relevant to the operations of negligence law. Moreover, it points up the relevance of the analysis offered to criminal law and employment law. It also highlights the problems of incommensurability and uncombinability as they arise in negligence law.
