The Commons Act 2006 introduced new powers for commons councils to self regulate land use. These measure are aimed , in part, at securing better environmental management of common land in SSSIs and other high nature value sites designated for legal protection. This article offers a critique of the 2006 Act, and concludes that it's failure to reform the idiosyncratic structure of property rights in common land may impair its effectiveness
