Abstract

The Working Group on Privacy, chaired by Mr. Brian Murray SC, delivered its report to the Government on 31st March 2006. It provided the framework for the Draft Privacy Bill (2006). This article will argue that, if there is to be a tort of invasion of privacy, then it should be limited to the protection of only some of the interests outlined in the present Draft Bill. The case is also made that European legal systems have a long history of trying to find a place for fundamental rights in private law. A focus of this article will be on the need for a more thorough comparison with our European neighbours.
