This article examines the relevance of knowledge in establishing liability for the reckless transmission of HIV under s.20 of the Offences against the Person Act 1861. It considers whether actual knowledge of HIV positive status is (or should be) necessary in order to impose liability. It also considers whether knowledge regarding the risks of transmission is (or should be) required.
